- Conditions
The following rules apply to members, visitors and users of this web site, referred to in this agreement as ‘united-dogwalkers.com’.
- Usage and membership
This service is for private use only, not for commercial use. By visiting united-dogwalkers.com acceptance of the general conditions of the united-dogwalkers.com is implied. Users explicitly accept the general conditions by becoming a member.
- Pictures and photos
Each member must submit a photo in which they are recognisable. The rest of the photos in the album can be filled as they wish. No pornographical or vulgar photos are permitted. This applies in particular to photos that violate German, US and European laws. It is also forbidden to submit photos of celebrities. If a photo does not comply with the conditions the user profile might be deleted.
The owner of united-dogwalkers.com accepts no responsibility for the submitted photos. The user is responsible for complying with the law.
united-dogwalkers.com members agree to publication of their photos on the internet. The united-dogwalkers.com owner retains the right to assess and publish the photos. Users can delete their photos and their complete profile at any time.
Users of and people who submit photos to united-dogwalkers.com exempt the united-dogwalkers.com owner from any third party claims. Note that photos and content submitted by users can be downloaded and used elsewhere.
The united-dogwalkers.com owner can use everything published on the site for any purpose, including reproductions, announcements, publications, broadcasting, transmissions, notices or for other partner websites.
- User/Member name:
The content and user names must not contain words or phrases that breach German, US and European laws, in particular racist or offensive terms. Insults and threats are not permitted.
- Homepage link:
Links to other commercial websites and websites with prohibited content are not permitted.
- User duties and obligations
Users are responsible for all content that they produce and publish. Every user, member and recipient of answers must treat all emails and other news as confidential and must not make them accessible without the author’s consent. The same applies to all forms of address data. Members must not use the platform inappropriately, in particular:
- they must not disseminate defamatory, false, insulting, obscene, blasphemous, vulgar, sexually explicit, threatening, annoying or racist remarks or point to such content using links
- links to websites with content that is similar to united-dogwalkers.com are also forbidden and give the united-dogwalkers.com owner the right to block the content and terminate the user’s membership
- sexually explicit photos are not permitted and will be deleted
- sexually explicit words and phrases are forbidden and will be deleted
- it is also forbidden to use any type of software within the platform or to allow others to access it
- availability of the service to others must not be affected
- messages sent within the platform may be sent only to arrange a date or to get to know someone, not to advertise or sell a product or a service
- non-compliance with one of the above obligations can result in civil or criminal litigation.
- Liability and guarantee
The united-dogwalkers.com owner is not liable for initial or resulting damage of any type, including damage for losses caused by work interruptions, computer failure or problems, or other damage or losses of any type, unless the damage is proven to be caused directly, either intentionally or with gross negligence, by elements of united-dogwalkers.com. The Hamburg state court decided on 12 May 1998 (- 312 O 85/98 -) in the case ‘Liability for links’ that the person liable for the content of a website is also liable for the content linked to that website. This can be prevented only if the person explicitly disclaims responsibility for the linked content. The united-dogwalkers.com owner disclaims responsibility for the content of all linked pages. This applies to all mentions of other websites, particularly to those put in users’ messages. The united-dogwalkers.com owner is not liable for breaches of copyright in relation to photos in messages. The person entering the data is responsible for the content of their message.
- Exemption
All members and users are obliged to exempt the united-dogwalkers.com owner from any liability and all obligations, expenses and claims resulting from slander, defamation, infringement of personal rights, loss of services for members and damage to immaterial goods or other rights.
- Data protection / third-party knowledge of data
This internet service is subject to the provisions of the German data protection law (BDSG–Bundesdatenschutzgesetz). When the service is functioning error-free the data stored on registration is accessible only to the administrator, so no data protection delegate is necessary. Members are aware that all data transmitted through the internet can be accessed without permission. Members accept this risk. There is no person-specific use of data.
- Commercial use of stored data
Data stored on registration is permitted to be used for sending information and advertisements. Only the united-dogwalkers.com owner (not third parties) may send information and advertisements by email. The stored email addresses are not provided or sold to advertisers
- Guarantee and availability
This service is generally available 24 hours 7 days a week. united-dogwalkers.com endeavours to ensure the server is available to the largest extent so content and stored messages are accessible, however this cannot be guaranteed. How united-dogwalkers.com functions is up to the owner – users have no right to the availability of the service at any time. Users are responsible for all information they give. united-dogwalkers.com is not liable for damages of any kind.
- Final determination
No oral secondary agreements are effective. If any provisions of these general conditions become void, the other provisions remain operative. Unless other provisions apply, an inoperative or unclear provision must be interpreted in a way that will achieve the intended commercial purpose. This agreement and its enforcement are subject exclusively to German law.
- Legal domicile
28209 Bremen, Germany is the legal domicile for all deliveries and services. The united-dogwalkers.com owner may transfer the agreement including all rights and obligations to a legal successor by statement.
- If a member contravenes provisions 3 and 4 their profile will be deleted. A member who grossly contravenes these provisions may be excluded from united-dogwalkers.com. The member would no longer be able to log in to united-dogwalkers.com.
